A penalty for unionist

One of our Clients wondered whether the member of the management board of the establishment’s trade union who is protected from the redundancy is liable for maintenance of order.

The Act on trade unions provides the defence only against redundancy or deterioration of work conditions. Also the provisions of the Labour Code concerning the liability for maintenance order do not grant  any special defence for trade union activists.

Thus, the members of the management board of the establishment’s trade union are not protected against imposing on them penalties for non-maintenance of order.
