Overtime work in harmful conditions

One of our Clients wondered whether employees working in harmful conditions may perform an overtime work in non-harmful conditions or the other way round.

Current provisions of the Labour Code do not allow to perform an overtime work by employees working in harmful conditions apart from taking part in rescue operations. It does not matter in which conditions they would perform an overtime work.

Nevertheless, employees performing work in normal conditions may perform work overtime in harmful conditions as long as they have medical certificate confirming lack of contraindications to the work in such conditions.
