Teamwork skills

One of our client was wondering whether he is allowed to dismiss his employee who cannot work in a team.

In order to answer to this question, it is worth to refer to the jurisprudence of the Supreme Court. In its judgment of 15 April 1999 (I PKN 14/99), Supreme Court ruled that employee's inability to work in a team can be a legitimate reason for termination of employment contract, regardless of his position and time of employment.

Lack of teamwork skills justifies termination of employment contract if employee’s behavior causes tension and bad atmosphere among team members.
