Termination of the labour contract

Clients often ask us how they should terminate an employee contract and how the meeting should progress. In the view of the risk, that the employee would not accept termination, leave the workplace, and go directly to the doctor to take the medical sick leave, we recommend, that other person should be present during such meeting, to confirm the correctness of termination.

However, the employer should be careful. Employees’ data may not be available for random people. Making information about termination accessible for unauthorized person  may constitute a violation of personal rights and provisions of the protection of personal data. Therefore, during the termination meeting should be present only people authorized to processing of personal data, e.g. employee from HR.
