Shorter contracts for a specified term

Polish Labor and Social Politic Minister declared yesterday (8 September) that in September we can expect the bill to amend Labor Code as regards the employment contracts for the specified term, prepared by the labor department. The amendment to the code will envisage the maximum period of the contracts for the specified time (up to 36 months) and longer notice period of such contracts – two weeks period is going to be replaced by period defined for the contracts for an indefinite period of time. What is more the amended regulations will assign on the employers the duty to define the cause justifying termination of the contract.

The planned amendment is a result of the verdict of the Court of Justice of the European Union issued in March 2014. The Court announced the verdict according to which the two weeks notice period for the specified-term contracts which not depends on the term of the employment discriminates the employees.
