Draft of changes in inheritance rules

Proposal of the changes in the Civil Code in respect of the heritage rules has been addressed to Sejm. With regard to general stability of the most important legislation in the private law the changes seem to be materially important. The rule governing inheritance up to present is – unless successors declare differently in six months – unlimited liability of the successor. The rule will be replaced by the rule of liability up to effective value of the estate (cum beneficio inventarii). Draft provides regulation of the inventory as the point of relevance for the liability of successors towards creditors.
