Withdrawal of the enforcement title negates the effects of breaking the course of limitation

In resolution dated 19th February 2015 (ref. act III CZP 103/14) the Supreme Court answered the court of second instance’s question, whether discontinuance of enforcement proceedings due to the withdrawal of the enforcement motion by a creditor after the assignment of receivables means that such withdrawal negates the effects of limitation.

In the Supreme Court's opinion discontinuance of the proceedings made at the request of the creditor - the bank, conducting the execution pursuant to the bank enforcement title - negates the effects of breaking the course of limitation caused by filing an enforcement motion.
