Trade unions for civil contracts workers

On 2 June 2015, the Constitutional Tribunal ruled that the provisions of law on trade unions, which reserve the participation in trade unions only for persons employed on employment contracts are inconsistent with the Polish Constitution.

Judgment of the Constitutional Tribunal means that trade unions will be available also to those who work on the basis of civil contracts (eg. service contract or task-specific contract) as well as to the self-employed. The Ministry of Labour and Social Policy has already announced an urgent amendment to the law on trade unions, executing the Tribunal’s judgment.
