Co-authors consent is not required for pursuing claims for infringement of copyright to the whole work

So held the Court of Appeal in Warsaw in its judgment of 7 May 2014 (ref. no ACA1663/13).

In its judgment the Court of Appeal concluded that the consent of other co-authors of the work is not necessary for the pursuing claims for copyright infringement to the whole work.

Court of Appeal confirmed that under current state of law, position expressed by the Supreme Court in its judgment of 20 June 1975 (ref no I CR 353/75), in which the Supreme Court hold that pursuing the claims by the co-authors is limited to their part of the work is no longer valid.
