Power of attorney and medical treatment of the child

On 13th May 2015 the Supreme Court adjudicated on a legal issue of the admissibility of granting by a parent a power of attorney to give consent to perform a medical treatment on a child, who remains under parental authority. (ref. n. III CZP 19/15)

According to the Supreme Court the statutory representative, vested with the parental authority over a minor child, may grant power of attorney to make a declaration of intent on giving consent which is mentioned in art. 34  of the Act of 5 December 1996 on the Medical Profession Act.
