Another significant amendment regarding consumers protection

On September 26th 2015 President of the Republic of Poland signed amendment to the competition and consumers protection act from February 16th 2007. New regulations provides many institutions which aim to ensure better protection of the consumers. The amendments will come into force six months after publication.

New regulations revolves around such issues as, among others,: possibility to express by the President of the Competition and Consumers Protection Office its opinion before the common courts of law in individual case, possibility to issue a temporary decision by the President of CCPO in cases regarding consumers collective interest, institution of mystery client, and restrictions in offering financial services to consumers.

However, the most significant amendment regards new model of provisions of the standard contracts control – President of CCPO will be examining the unlawful character of specific provision of standard contract. The legislator resigned from the extended validity of the Court of Competition and Consumer Protection’s decisions regarding finding of unlawful character of specific provision of standard contract, what will be replaced by decision of President of the Competition and Consumers Protection Office regarding finding of unlawful character of specific provision of standard contract, the decision shall be addressed to concrete entrepreneur and to the consumers, who concluded contract with this entrepreneur. What is more the register of abusive clauses will be replaced by register of President of CPPO’s decisions.
