Health and safety in instructions

On 24 November 2015 the Constitutional Tribunal announced the judgment concerning the regulation of health and safety at work of the following service: the Police, the Boarder Guard, the Customs Service, the Military Counterintelligence Service, the Military Intelligence Service, the Central Anti-Corruption Bureau, the Internal Security Agency and the Foreign Intelligence Agency.

According to this judgment the regulation of the issue of health and safety at work in instructions is contrary to the article 66 section 1 of the Constitution, which requires that the right to the health and safety work environment shall be regulated by the Parliament legislation.

The provisions permitting to issue such instructions will lose their binding force after 12 months.
