Suspension and termination

Under article 276 of the Code of Criminal Procedure the employee may be suspended in the execution of his official or professional duties.

On 10th December 2015 the Supreme Court stated (III PZP 7/15) that such a suspension, lasting longer than 1 month, cannot be a basis of the termination of the employment contract without a notice through no fault of an employee under article 53 §1 point 2 of the Labour Code.
