25 years of imprisonment (for VAT fraud)

The Ministry of Treasury has prepared a novelization of the Polish criminal code, which introduces punishments for VAT fraud, including forging invoices.

According to PwC’s report in November, 2015 the loss of the Treasury caused by VAT crimes reached from 36,5 to 58,5 bn zlotych.

The Treasury propones introducing a rule according to which a person who forges or converts an invoice in the scope of a public receivables or uses such invoice as an authentic, is subject to imprisonment from 6 months to 8 years. An aggravated form of this crime is also anticipated. This form would be applied to organized criminal groups, which cause major economic loses.

Offenders who have committed the most serious crimes would be subject to imprisonment from 5 to 15 years or even 25 years of imprisonment.
