Other restructuring for banks and coop funds

Due to the need to implement into national legal order Directive 2014/59/EU of the European Parliament and of the Council and Directive 2014/49/EU of the European Parliament and of the Council, the Parliament, on 10th June 2016. pass an Act on the Bank Guarantee Fund, the deposit guarantee scheme and forced restructuring. This Act amends and repeals certain provisions of the Restructuring law.

The legislator has expanded the list of entities which are not subject to the Restructuring law of domestic banks (previously only state-owned banks and deposit banks), Bank Gospodarstwa Krajowego, branches of foreign banks, cooperative savings and credit funds (SKOK), also some types of investment and holding companies.

The consequences of the exclusion of domestic banks and SKOKs with the subjective scope of the Restructuring lawand comprehensive regulation restructuring of these entities in the newly passed Act were repealed provisions of the Restructuring lawgoverning the distinct restructuring proceedings against banks and SKOKs.

Planned amendments to the Restructuring lawshall come into force on 9th October 2016.
