Posting of workers – after September 18th, 2016

The law on the posting of workers in the framework of the provision of services entered into force on June 18th, 2016 but some of its provisions apply to employers from September 18th, 2016. It was associated with the obligation to implement the relevant directive of the European Parliament and of the Council concerning the posting of workers.

The regulation prevailed during posting policies and established uniform elements that the EU level facilitate the common interpretation of the provisions and prevent the abuse and circumvention of the rules in force. It requires foreign companies to register the fact of posting the employee and pay him the minimum wage in force in the host country. To September 18th, the company that are affected by this adjustment, took the time to adjust their procedures to the new law.

For example: the need to maintain records concerning the posting; the establishment of the person for contacts with the competent authorities of the host State; obligation to submit to the competent authority of the statements, which will allow to carry out factual checks.
