Driving license and Constitution

The Constitutional Court in its judgement of October 11, 2016 - act signature K 24/15, ruled on the unconstitutionality of the provisions concerning speeding in built-up areas over the speed limit by more than 50 km/h, to the extent that these regulations do not take into account the protective force. Such conditions can occur in case of for example the threat to life or health of passengers or when the husband carries his pregnant wife to the hospital.

The allegation of the unconstitutionality of these regulations to the extent of "double punishment" - a speeding ticket and to take away driving license at the same time, was considered unfounded because the first one is an administrative sanction and the second one is a criminal regulation.
