Longer terms to file a claim

MP’s bill amending Polish Labour Code from 28th April, 2016 establish an amendment of article 264 which aim is to prolong up to 30 days terms for:  a claimagainst the termination of an employment contract, a claim for reinstatement in a job position, or for compensation as well as a claim to establish an employment contract. The bill is at the stage of first reading in Parliament (print No. 524).

Currently,a claimagainst the termination of an employment contract  must be filed within 7 days from the delivery of the letter notifying of the termination of the employment contract with notice.  A claim for reinstatement in a job position, or for compensation, must be filed with the labour court within 14 days from the delivery of the notification of the termination of the employment contract without notice, or of the date of the expiry of the employment contract. A claim to establish an employment contract must be filed within 14 days from the delivery of the notification on the rejection of granting employment.

These terms are thought to be too short for an employee in order to assess whether the notice is legitimate and legal.
